Welcome to Yugan Builds.
These Terms of Service ("Terms") govern your access to and use of the Yugan Builds website, online store, products and related services (collectively, the "Services").
In these Terms, "Yugan Builds", "we", "us" and "our" refer to the business operating the Yugan Builds store. "You" and "your" refer to any person who accesses the Services or purchases products from us.
By accessing our website, placing an order or otherwise using our Services, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our Services.
These Terms are intended to apply to purchases made in Malaysia and are governed by Malaysian law.

2. Eligibility
You may use our Services only if you are legally capable of entering into a binding agreement under applicable law.
If you are under 18 years old, you should use our Services only with the involvement and consent of a parent or legal guardian where required by law.
By using our Services, you confirm that the information you provide to us is accurate and complete.
3. Our Products
We make reasonable efforts to ensure that product descriptions, photographs, dimensions, colours, materials and other product information displayed on our website are accurate.
Because our products are handcrafted, minor variations in wood grain, colour, texture, knots, markings and finish may occur. These natural variations are not necessarily defects and may form part of the character of the product.
Colours displayed on a screen may also differ slightly from the actual product depending on your device, display settings and lighting conditions.
Where a product is made from natural wood, no two pieces will be completely identical.
We reserve the right to update product information, specifications, availability and pricing when reasonably necessary.
Nothing in these Terms excludes or limits any rights or remedies you may have under applicable Malaysian law.
4. Product Safety and Use
Our products must be used in accordance with any instructions, warnings and safety information supplied with the product.
Unless expressly stated otherwise, our lighting products are intended for their stated environment and purpose only.
You must not modify, dismantle, alter, bypass, repair or otherwise interfere with electrical components supplied with a product unless this is expressly permitted by us or carried out by an appropriately qualified person.
You are responsible for using the product safely and in accordance with applicable instructions.
If you believe a product may be unsafe, damaged or defective, stop using it and contact us promptly.
5. Product Availability
All products are subject to availability.
We may limit quantities, discontinue products or temporarily remove products from sale.
If we are unable to fulfil an order after payment has been received, we will contact you and arrange an appropriate resolution, which may include a refund where applicable.
6. Orders
When you submit an order through our website, you are requesting to purchase the products specified in your order.
Before submitting your order, you are responsible for checking that your product selection, quantity, delivery address, contact details and other order information are correct.
We will provide an acknowledgement of your order without undue delay.
An order may be cancelled or rejected where reasonably necessary, including where:
-
a product is unavailable;
-
there is an obvious pricing or product-description error;
-
payment cannot be successfully processed;
-
information supplied by you is materially incorrect;
-
we reasonably suspect fraud or unauthorized activity; or
-
circumstances outside our reasonable control prevent fulfilment.
If we cancel an order after receiving payment, we will provide an appropriate refund for amounts paid for the cancelled order, subject to applicable law.
Nothing in this section removes any rights available to consumers under Malaysian law.
7. Prices
All prices displayed on our website are stated in Malaysian Ringgit (RM), unless otherwise specified.
The total amount payable will be displayed during checkout and may include the product price, applicable delivery charges, taxes and other charges that are applicable to the order.
We may change prices from time to time. The price applicable to your purchase will be the price displayed at the time you place your order, except where an obvious pricing or listing error has occurred.
If we discover an obvious pricing error before an order has been fulfilled, we may contact you regarding the error and provide you with the option to proceed at the correct price or cancel the affected order.
8. Payment
Payment must be made using the payment methods made available through our checkout.
Payment services may be provided by third-party payment providers. Your use of a third-party payment method may also be subject to that provider's own terms and policies.
We do not store complete payment card information where payment processing is handled by a third-party payment provider.
We may decline or cancel an order if payment is unsuccessful, reversed, unauthorized or reasonably suspected to be fraudulent.
9. Shipping and Delivery
We deliver to locations made available during checkout.
Estimated delivery times will be communicated through our website, checkout, order confirmation or shipping information.
Delivery times are estimates and may be affected by circumstances outside our reasonable control, including courier delays, severe weather, public holidays, address issues, customs processes and other unforeseen events.
You are responsible for providing an accurate and complete delivery address and contact information.
If a parcel cannot be delivered because of an incorrect or incomplete address, refusal to receive the parcel or repeated failed delivery attempts attributable to the customer, additional delivery charges may apply where permitted by law.
If an item arrives damaged, materially different from what was ordered or defective, please contact us as soon as reasonably practicable with your order details and, where appropriate, photographs or video showing the issue.
Where applicable under Malaysian law, we will bear the reasonable cost of re-delivery or other appropriate remedy for goods that are materially different from the goods ordered or contain a defect.
10. Returns, Refunds and Exchanges
Returns, refunds, cancellations and exchanges are handled in accordance with our Return and Refund Policy, which forms part of these Terms.
Nothing in our Return and Refund Policy or these Terms is intended to remove or restrict any mandatory consumer rights or remedies available under Malaysian law.
Where a product is defective, materially different from what was ordered, or otherwise does not comply with applicable statutory guarantees, we will assess the issue and provide the remedy required by applicable law.
For personalized, customized or made-to-order products, additional terms may apply where these have been clearly disclosed before purchase and are permitted by applicable law.
11. Cancellation Requests
If you need to cancel an order, contact us as soon as possible at hello@yuganbuilds.com.
We will consider cancellation requests based on the status of the order and whether production, preparation or shipment has already commenced.
A cancellation request does not automatically create a right to cancel where applicable law does not provide such a right. Any applicable cancellation rights will be determined in accordance with Malaysian law and our Return and Refund Policy.
12. Intellectual Property
All content appearing on our website and Services, including our brand name, logos, photographs, product designs, graphics, videos, text, illustrations, layouts and other materials, belongs to Yugan Builds or is used with permission from the relevant rights holder.
You may access and use our website for personal and lawful purposes.
You must not reproduce, copy, modify, distribute, publish, sell, commercially exploit or create derivative works from our content without our prior written permission, except where permitted by law.
You must not use our branding, photographs or product images in a way that suggests an unauthorized relationship, endorsement or affiliation with Yugan Builds.
13. Customer Reviews and Feedback
If you voluntarily submit a review, photograph, video, testimonial, suggestion or other feedback to us, you grant Yugan Builds a non-exclusive, worldwide, royalty-free license to use, reproduce, display and publish that content for legitimate business purposes, including displaying customer reviews and promoting our products.
You represent that you have the necessary rights to any content you submit.
You must not submit content that is unlawful, misleading, defamatory, abusive, obscene, infringing or otherwise inappropriate.
We may remove or decline to publish content that we reasonably consider to violate these Terms or applicable law.
14. Website Use
You agree to use our website only for lawful purposes.
You must not:
-
interfere with the operation or security of our website;
-
introduce viruses, malware or other harmful code;
-
attempt to gain unauthorized access to our systems;
-
impersonate another person or provide misleading information;
-
use our website for fraudulent purposes;
-
unlawfully collect personal information from other users;
-
use automated systems to disrupt or abuse our Services; or
-
use our website in a manner that violates applicable Malaysian law.
We may restrict or suspend access to our Services where reasonably necessary to protect our website, business, customers or other users.
15. Third-Party Services and Links
Our Services may use or integrate with third-party services, including Shopify, payment providers, delivery providers, analytics services and other technology providers.
Third-party services may have their own terms and privacy policies.
We are not responsible for the independent operation, content or policies of third-party websites or services, except to the extent required by applicable law.
16. Shopify
Yugan Builds uses Shopify to operate and provide our online store and checkout.
However, purchases made through our store are transactions between you and Yugan Builds.
Shopify provides the technology platform that enables us to operate the store but is not the seller of our products.
Your use of Shopify-powered portions of our Services may also be subject to Shopify's applicable terms and policies.
17. Privacy and Personal Data
We collect, use, store and disclose personal information in accordance with our Privacy Policy and applicable Malaysian data protection laws.
Personal information may include information such as your name, contact details, delivery address, order information, payment-related information and technical information required to operate our website and fulfil your purchases.
Because our store is powered by Shopify and uses third-party service providers, your personal information may be processed or transferred by those providers for purposes including payment processing, order fulfilment, delivery, website operation, customer support, security and analytics.
Further information about how your personal data is handled is provided in our Privacy Policy.
18. Errors and Corrections
We make reasonable efforts to ensure that information on our website is accurate.
However, occasional errors, inaccuracies or omissions may occur, including errors relating to product descriptions, pricing, availability, promotions, delivery charges or estimated delivery times.
Where permitted by law, we may correct such errors and update information.
If an error materially affects an order that you have placed, we will communicate with you and provide an appropriate resolution in accordance with applicable law.
19. Events Outside Our Reasonable Control
We will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, severe weather, fire, flood, government action, power outages, major service interruptions, courier disruptions, strikes, civil disturbances or other events that could not reasonably have been prevented or avoided.
This section does not remove any rights or remedies that cannot legally be excluded.
20. Liability
To the maximum extent permitted by Malaysian law, we are not responsible for losses that are not reasonably foreseeable or that arise from your misuse of our products or Services.
However, nothing in these Terms excludes, restricts or modifies:
-
any liability that cannot lawfully be excluded or limited;
-
any statutory consumer guarantee, right or remedy;
-
liability for fraud or fraudulent misrepresentation; or
-
any other protection that applicable Malaysian law requires us to provide.
Where liability can legally be limited, our liability will be limited to the extent permitted by applicable law.
21. Indemnity
To the extent permitted by law, you agree to be responsible for losses or claims reasonably arising from your unlawful use of our Services, your breach of these Terms, or your infringement of another person's rights.
This section does not apply to the extent that the relevant loss or claim results from our own unlawful conduct or cannot legally be imposed on you.
22. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it lawful and enforceable where permitted.
If it cannot be made enforceable, the affected provision will be severed without affecting the validity of the remaining provisions.
23. No Waiver
If we do not immediately enforce a right or provision under these Terms, that does not mean that we have permanently waived that right or provision.
24. Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, Services, products, technology or applicable legal requirements.
The latest version will be published on this page with the updated date.
Where required by law, we will provide appropriate notice of material changes.
Your continued use of our Services after an updated version becomes effective constitutes acceptance of the updated Terms to the extent permitted by law.
25. Governing Law
These Terms are governed by and interpreted in accordance with the laws of Malaysia.
Any dispute arising from these Terms or your purchase from Yugan Builds will be subject to the applicable laws and jurisdiction of Malaysia.
Nothing in these Terms prevents a consumer from exercising any statutory rights or remedies available under Malaysian law, including any applicable rights to make a claim before the Tribunal for Consumer Claims Malaysia or another competent authority or court.
